Medicaid Planning

Medicare covers expenses in a nursing home, but only under certain circumstances for a limited time period.  Once those circumstances and time period are over, if you or your loved one is unable to return home, you must either be private pay or qualify for Medicaid.  The averaging nursing home in Colorado costs approximately $6,500 per month.  If there are assets, they may be diminished quickly. Guardianship / Conservatorship

In certain situations, for example, if someone has more than the beginning stages of Alzheimer’s or dementia, there may be the lack of legal capacity to enter into a contract. In these cases, if there are not previous powers of attorney set up naming an agent to step in, a guardianship and/or conservatorship is needed.  In Colorado, the guardianship appoints a person, usually a family member, to make health decisions on behalf of the person who no longer has the ability to make informed decisions on their own.  The conservatorship appoints a person to deal with the financial matters.  In both cases, the District Court, or Probate Court in Denver County, will oversee the process and appoint the guardian and/or conservator.  Our law firm has extensive experience in these matters.
